Terms of Service for TCGListings.com

TCGListings.com is an open marketplace dedicated to providing a platform for trading card game (TCG) enthusiasts to buy, sell, and share TCG-related items, including cards, binders, sealed products, and accessories. We promote fair trade, community building, and minimal fees to support the TCG community.

By accessing or using TCGListings.com (the "Website" or "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and TCGListings.com (operated by [Your Company Name or "us", "we", "our"]). We reserve the right to modify these Terms at any time. Continued use of the Site after changes constitutes your acceptance of the updated Terms. We will notify users of significant changes via email or site announcements.

2. User Accounts

To use certain features, such as listing items for sale, purchasing, or managing binders, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, including but not limited to fraudulent activity, spam, or illegal conduct.

3. Marketplace Rules

TCGListings.com is a platform for buying and selling TCG-related items. All listings must be genuine TCG products or accessories. Prohibited items include counterfeit goods, non-TCG items, or anything illegal under U.S. law.

  • Listings: Sellers must provide accurate descriptions, images, prices, and shipping details. All prices are in United States Dollars (USD).
  • Fees: We charge a flat 5% fee on sales to cover PayPal processing and operational costs. No subscriptions or hidden fees.
  • Payments: All transactions are processed via PayPal. Buyers pay sellers directly, minus our fee.
  • Shipping: Shipping is charged once per seller per order (grouped shipping). Sellers can set domestic (USA) and international rates. Buyers are responsible for any customs fees or duties.
  • Disputes: Buyers and sellers should resolve issues amicably. We may mediate but are not liable for disputes. Use PayPal's dispute resolution for payment issues.

4. Content and Uploads

Users may upload images, descriptions, and other content for listings or binders. You retain ownership of your content but grant us a non-exclusive, royalty-free license to display, reproduce, and distribute it on the Site.

You are solely responsible for your content. We do not endorse or verify user content and disclaim all liability for it.

Warning on Illegal Content: Do NOT post, upload, or share any content that involves illegal activities, including but not limited to child exploitation, pornography involving minors, counterfeit goods, drugs, weapons, or any material that harms or exploits vulnerable individuals.

Any content depicting or advocating abuse of minors (e.g., "teens", "young girls", "jailbait", or anything questionable) will be REMOVED IMMEDIATELY and REPORTED TO THE AUTHORITIES. NO EXCEPTIONS. We will cooperate fully with law enforcement, including providing user information, and we will do so with a smile if it means protecting children or upholding the law. You sick individuals will face justice.

We broaden this to all illegal content: If you upload or engage in anything stupid, harmful, or illegal, we take no fault, disclaim all liability, and will work with law enforcement to ensure justice is served.

5. Payouts to Sellers

Payouts are processed via PayPal after the order is shipped, marked as shipped by the seller, and a 7-day holding period has passed to allow for buyer disputes. Payouts occur on Mondays at 3:00 PM Central Time and may be subject to change with notice.

We deduct our 5% fee before payout. Sellers are responsible for taxes on earnings.

6. Intellectual Property

The Site's design, logos, and software are owned by us or our licensors. You may not copy, modify, or distribute them without permission.

Respect others' IP: Do not list counterfeit or infringing items. We may remove listings that violate IP rights.

7. Prohibited Activities

  • Spam, scams, or fraudulent listings.
  • Harassment, hate speech, or discrimination.
  • Unauthorized access or hacking attempts.
  • Any activity that violates laws or these Terms.

We may monitor activity and remove content or ban users at our discretion.

8. Disclaimer of Warranties

The Site is provided "AS IS" without warranties of any kind. We do not guarantee accuracy, availability, or fitness for a particular purpose. Use at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, including lost profits or data.

Our total liability shall not exceed the fees paid by you in the past 12 months.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Site, your content, or violations of these Terms.

11. Governing Law

These Terms are governed by the laws of the United States and the State of [Your State, e.g., California], without regard to conflict of laws principles. Disputes shall be resolved in [Your City/County] courts.
